Términos y Condiciones de Uso – MX Digital Media

1. Identificación de la Empresa

El sitio web es operado por MX Digital Media, empresa legalmente constituida en Colombia. Al acceder y utilizar este sitio, el usuario acepta cumplir con los presentes Términos y Condiciones.

2. Objeto

MX Digital Media ofrece a través de su plataforma la venta de productos digitales (descargas, accesos a plataformas, contenido multimedia, etc.). La adquisición de estos productos otorga al usuario una licencia de uso personal, no exclusiva y no transferible.

3. Precios y Pagos

Moneda: Todos los precios están expresados en Pesos Colombianos (COP) e incluyen los impuestos de ley (IVA), si aplica.

Pasarelas de Pago: Los pagos se procesan a través de plataformas seguras de terceros. MX Digital Media no almacena información de tarjetas de crédito o débito.

Confirmación: La entrega del producto digital se realizará una vez se confirme el pago exitoso.

4. Entrega de Productos Digitales

Debido a la naturaleza de los bienes, la entrega se considera realizada en el momento en que se envía el enlace de descarga o las credenciales de acceso al correo electrónico proporcionado por el usuario. Es responsabilidad del cliente asegurar que la información de contacto sea correcta.

5. Derecho de Retracto y Devoluciones

De acuerdo con el Artículo 47 de la Ley 1480 de 2011, el derecho de retracto tiene excepciones. Al tratarse de bienes que, por su naturaleza, no pueden ser devueltos o son de consumo inmediato (productos digitales cuya ejecución haya comenzado con el acuerdo del consumidor), el usuario acepta que:

No habrá lugar a retracto una vez que se haya iniciado la descarga o el acceso al contenido digital, por ser este un servicio exceptuado por la ley colombiana.

6. Propiedad Intelectual

Todo el contenido disponible en MX Digital Media (textos, gráficos, logos, códigos, videos) es propiedad de la empresa o de sus licenciantes y está protegido por las leyes de derechos de autor. Queda estrictamente prohibida la reproducción, distribución o reventa del material sin autorización expresa.

7. Protección de Datos Personales

En cumplimiento de la Ley 1581 de 2012, los datos personales recolectados serán tratados conforme a nuestra Política de Tratamiento de Datos, con la finalidad de gestionar la compra, el soporte técnico y el envío de comunicaciones comerciales (siempre que el usuario lo autorice).

8. Limitación de Responsabilidad

MX Digital Media no se hace responsable por:

Interrupciones técnicas en la red o en el acceso al sitio ajenas a nuestro control.

Uso indebido de los productos digitales por parte del comprador.

Incompatibilidad técnica de los archivos con los dispositivos del usuario (se recomienda revisar los requisitos previos a la compra).

9. Ley Aplicable y Jurisdicción

Estos términos se rigen por las leyes de la República de Colombia. Cualquier controversia será resuelta ante las autoridades competentes en territorio colombiano.

MX DIGITAL MEDIA   (the ” MX DIGITAL MEDIA “) websites (the ” MX DIGITAL MEDIA Websites”) provide content and features (the “Services”) for MX DIGITAL MEDIA   clients, medical and healthcare professionals, and public users. This statement describes the terms and conditions of use of the Services. By using the Services in any manner or by registering or by logging in to the Services you are stating that you agree to be bound by and adhere to the terms and conditions of use in this statement.

The Services do not provide medical advice. The text, graphics, photos, videos and other information (the “Content”) is not intended as medical advice and should not be considered medical advice. Always seek the advice of a qualified board‑certified plastic surgeon regarding any medical condition or procedure.

The Services may display Content that is graphic in nature and that may depict partial or full nudity. If you find such material offensive you should not use the Services or you should exercise caution before accessing certain features of the Services.

You must be at least 18 years old to have our permission to use the Services. We do not knowingly collect, use or disclose personally identifiable information about visitors under 18 years of age.

User Contributions

You fully are responsible for all Content, including but not limited to registration data, photos, videos, comments, text, documents and other information (“User Submissions”) that you upload, enter or post using the Services. You agree that you will not upload any User Submission that infringes or violates any rights of any party or that compromises the privacy of any person or patient. You hereby grant MX DIGITAL MEDIA   an irrevocable, worldwide, royalty-free, perpetual, transferrable, and fully sublicensable right and license to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform any and all such User Submissions throughout the world in any media, now known or hereafter devised and (b) use the name that you submit in connection with such User Submission. You expressly waive any and all “moral rights” (including rights of attribution or integrity) that may subsist in your User Submissions and agree that you have no objection to the publication, use, modification, deletion or exploitation of your User Submissions by MX DIGITAL MEDIA, or any of MX DIGITAL MEDIA’s partners or licensees. You acknowledge that MX DIGITAL MEDIA may exercise its rights (e.g., use, publish, delete) to any content you submit without notice to you. MX DIGITAL MEDIA has no obligation to post your comments and reserves the right in MX DIGITAL MEDIA ‘s absolute discretion to determine which comments are published as part of the Services. You acknowledge that MX DIGITAL MEDIA  may choose to provide attribution of your comments or reviews at its discretion, and that such User Submissions may be shared with our supplier partners. You further grant MX DIGITAL MEDIA  the right to pursue at law any person or entity that violates your or MX DIGITAL MEDIA ‘s rights in the Content by a breach of these Terms. If you do not agree to these Terms, please do not provide us with any User Submissions.

The contributions of third parties do not necessarily represent the views or opinions of MX DIGITAL MEDIA  cannot preview User Submissions before they appear.

MX DIGITAL MEDIA ‘s policies with respect to claims by third parties that the content of the Service, including any User Submission, infringes the copyrights owned by such third party can be found in the DMCA section below.

You may not use the “Find a Surgeon” feature, the search feature or any contact information on this site for the purposes of commercial solicitation of MX DIGITAL MEDIA  member physicians or any other individual.

The Services and the Content, including but not limited to white papers, press releases and procedure descriptions, are protected by U.S. and/or foreign copyright laws, and belong to MX DIGITAL MEDIA or its partners, affiliates, contributors or third parties. The copyrights in the Content are owned by MX DIGITAL MEDIA or other copyright owners who have authorized their use on the site. You may download and reprint Content for noncommercial, nonpublic, personal use only. If you are browsing this site as an employee or member of any business or organization, you may download and reprint Content only for educational or other noncommercial purposes within your business or organization, except as otherwise permitted by DR MX DIGITAL MEDIA. You may not manipulate or alter in any way images or other Content on the site.

You agree that MX DIGITAL MEDIA  has no obligation to monitor the Services but may do so at its sole discretion and may review content that has been posted to the Services under your account and that MX DIGITAL MEDIA, if it finds that content to be unacceptable for posting for any reason reserves the right to delete the content with any notice or obligation to you. You agree that MX DIGITAL MEDIA  reserves the right to terminate your account or limit your access to any or all of the Services at any time without notice for any reason.

Esta política se rige por la Constitución Política de Colombia, la Ley 1581 de 2012, el Decreto 1377 de 2013 y demás normas que las modifiquen o adicionen, garantizando el derecho de los ciudadanos a conocer, actualizar y rectificar la información que se haya recogido sobre ellos.

3. Finalidad del Tratamiento de Datos

Los datos personales que MX Digital Media recolecta (nombre, correo electrónico, teléfono, ciudad, datos de facturación) serán utilizados para:

• Gestionar la compra y entrega de los productos digitales adquiridos.
• Prestar servicios de soporte técnico y atención al cliente.
• Realizar el envío de facturación electrónica según la normativa de la DIAN.
• Enviar boletines informativos, promociones y actualizaciones de productos (solo si el usuario ha dado su autorización expresa).
• Realizar análisis estadísticos para mejorar la experiencia de usuario en nuestra plataforma.

4. Derechos de los Titulares

Como titular de sus datos personales, usted tiene derecho a:

1. Conocer, actualizar y rectificar sus datos personales frente a MX Digital Media.
2. Solicitar prueba de la autorización otorgada.
3. Ser informado sobre el uso que se le ha dado a sus datos personales.
4. Presentar quejas ante la Superintendencia de Industria y Comercio (SIC) por infracciones a la ley.
5. Revocar la autorización o solicitar la supresión de sus datos cuando no se respeten los principios, derechos y garantías constitucionales y legales.

5. Seguridad de la Información

MX Digital Media adopta medidas técnicas, humanas y administrativas necesarias para otorgar seguridad a los registros, evitando su adulteración, pérdida, consulta o uso no autorizado. Utilizamos protocolos de seguridad estándar para la protección de datos en línea.

6. Transferencia a Terceros

Sus datos personales podrán ser compartidos con terceros aliados (como pasarelas de pago o servicios de hosting/automatización de correos) únicamente para las finalidades descritas en esta política y bajo contratos que aseguren el cumplimiento de la Ley 1581 de 2012. MX Digital Media no vende ni alquila sus bases de datos a terceros.

7. Procedimiento para el Ejercicio de Derechos

El titular de los datos puede ejercer sus derechos de consulta o reclamo enviando una comunicación escrita al correo electrónico: mxdigitalmp@gmail.com.

• Tiempo de respuesta: Las consultas serán atendidas en un término máximo de diez (10) días hábiles; los reclamos, en quince (15) días hábiles.

8. Vigencia

La presente política entra en vigencia a partir del 3 de Febrero de 2026. Los datos personales permanecerán en nuestra base de datos durante el tiempo que sea necesario para cumplir con las finalidades mencionadas o mientras exista una obligación legal o contractual.
